I guess I just fear for the future, there's so many remakes out there and I have always dreaded if it will happen to our beloved bond franchise. Reboots and direct sequels have happened, which I can (just about) live with, but a remake with the same title, I could not live with. Not with bond. It's not the way it should be. Cubby would have never allowed it either.
I can't see any way EON would ever agree to sell the competitor's films in a package with theirs, no matter who owns the rights, but I can see how "All the Bond films gathered together for the first time" is misleading to those who aren't aware of which films aren't part of the series.
To win their lawsuit, the plaintiffs would have to prove they were damaged by the omission of the two films whereas I would argue the set is worth more without them.
