I clearly stated in black and white that there was 50% to be paid at the start, and 50% at the end. If you decide to pull out half way through—not because of the product so far, or because of anything else pertaining to it, just because you changed your mind—how can you expect to get all your money back?
I am going to Venezuela this summer coming, and at the start I had to pay a deposit of around £300. If I had chosen to pull out of that the very next day after paying, I would lose that deposit, regardless of anything else.

Saw this thread ages back when it was getting started and I'm working away so haven't seen it until now. I really wasn't going to get involved as I certainly didn't commit anything to it, money or intellectually. But after looking at it over and over in utter disbelief, I'm at the 'bugger that!' stage. I'm not going to get into a debate on the OP and organiser or the agenda, but will state two very big and salient facts.
No professional jeweller in Europe or the UK will make a prototype on brass or any other metal. It is all done in wax
That prototype was not made by a jeweller with any experience in jewellery whatsoever. Even one days worth!
Anyone that knows me will know that my family background in watches and jewellery goes back three generations. A wax proto I could have done for anybody at any jewellers in the Jewellery Quarter for a £20 deposit. This would have been fully refundable by any reputable caster if the proto did not match up to the expectations.
I suggest those involved either take a big leap of faith, which certainly is inadvisable with all the weighty evidence and attitude presented. Get your 50% deposit back and put the rest down to experience. Or get the full amount back legally.

Thanks Asp9mm. I completely agree. Not to mention that he said the whole amount could be refunded through Paypal (before unilaterally deciding after payment was made that 50% would not be, and by pointing out that Paypal would not refund custom-made items).
If Mac lived in Quebec (province of Canada) we have a court for small affairs like this where you can represent yourself if you ask less than 7000$ and he would definitely lose.

It's called the 'small claims court' and usually costs £150 to have your grievance heard. If the defendant is ruled against then they will be liable for payment of all costs.

Seriously chaps, if you still have time to contact paypal, open a claim NOW! you have over a month before you have to refer it to their decision makers, but if it's not open before the end of the 45 day period you're stuffed, IF MAC comes up with a viable solution or acceptable prototype you can always close the claim.

Just for the record, I've decided to keep quiet and keep my fingers crossed. With Paul getting more involved in the project, I'm feeling a little better about the project's chances. At best, I'll get some nice looking cufflinks that will look like the real deal to the casual fan; at worst, I'll have a conversation piece and a valuable life lesson.
Also, I agree with many of the comments by members who fear that too many people have been soured by this project, and thus, we may never see another AJB project launched again. So regardless of how this project turns out, I would really love to see this board get back on the proverbial horse, and consider launching a new project soon. Maybe something relatively simple. Just my humble opinion.
Nothing stopping us from clubbing together and approaching manufacturers and traders of desired items for the best rates.
I can't understand how someone would only contact ONE «company» (if it is one)... like.. YOU HAVE TO SHOP AROUND! But of course it takes time and effort, that's why there are not so many projects like this.

Hey welcome back asp! Been too long - bond toys had no one to joust with ( I was a poor imitation) and so no surprise he's been getting his teeth into anything bone-like...
Ok firstly I had a great chat with Luke - and bottom-line I'm convinced he is solid, genuine and capable.
But he deeply regrets this thread as do most of us, and we agreed that he would come up with a solid plan of action overnight. I think it's best he sleeps on the discussion we had and replies tomorrow.
This is lukes project and I'm not going to take any of the credit that he deserves in completing it. That includes how he handles the muddle we've ended up with.
Hence I'm not going to leak and details. Please understand.
But I will say one thing. This is a fine young man who has been embroiled in a bar fight and has reacted like any of us would or have; defenses go up and adrenaline feeds bravado.
I'm not sure too many on this thread can hold their head high when faced with EVERY single thing they've written. Certainly not I and nor Luke.
I feel lukes response will cover the important questions raised by many (lately by asp) re quality and copyright, but most of all I'm confident that tom sawyer will be satisfied and lukes true intent re: finances will become evident.
Personally I am waiting for Paul's plan to come into action. Sorry but I got no faith in Mac and am somewhat annoyed by his actions andlack of action. However, Paul is very different and I hope he will be able to find a way of sorting this mess out.

Well... now that I'm 'out of the project', I would first like to thank mac for sending the refund, and second i want to apologize to Mac for any insults from me or anything like that, it was nothing personal Mac, just really needed the money back almost to the point of desperation(it would seem)..
I first of all would like to thank Paul, with whom I talked on the phone last night for just over an hour. I could count on one hand the number of people who seem to continually make profound statements and he is now amongst them. He is a very nice person, understanding and gracious. He understood how it’s hard when people are attacking you not to fight back, however he invited me to take a step back and view it from other perspectives—which I fear I haven’t been doing.
This a first class forum with clearly a lot of knowledgable members. I came here with a love for James Bond and intending on doing the cufflink project as I couldn’t find a pair for a relatively reasonable price. I approached it with naivety thinking it could be done in 4-6 weeks with no problems. As such, I never thought about the refundable deposit. That was clearly a mistake on my part, which will only come with experience. It seems that I have retained the loyalty of most of my customers, which is a gift. If it had been the other way around with people who I had paid attacking me, this might not have survived and would have left a terrible taste in the mouths of everyone involved.
I have learned a huge amount from this project and will no doubt take said experience over to Mac Guitars to improve the way I treat customers and the way I run my business. It is clear to me that I need to remain open and continually engage with not only the customers involved, but also the members who aren’t—as they no doubt have more experience than me and if we cut through the arguments, have addressed numerous important points.
I handled the initial criticism badly and retaliated, which only made things worse and in turn that snowballed. I had no intention of keeping anyone’s money against their will, but with the continual attacks from senior and experienced members, I feared that everyone would ask for their refund, the project would not be completed and this would be a terrible dent in the history of AJB. However, as proof of good faith, TomSawyer has received his full £198 refund. Moreover, if anyone else wants to take 50% back I am happy to do that. This in no way affects the status of the other 50%, which is also refundable.
With regards to the prototype, it is made by a company in the USA, not the UK company as they were becoming increasingly difficult to work—taking 5-10 days to reply to my emails. I do not want to reveal the name of the business but can confirm they are experienced in the production of men’s clothing and accessories. The owner is a valued member at Style Forum and has been there for years with thousands of posts. The company in the UK had proposed to make it out of wax, but the company in the USA never suggested it, and instead wanted to do it with a cheaper metal. I can confirm again that the final product will be solid silver, with the next prototype also being solid.
As with copyright issues, I took them less seriously than I should have and here is what I propose: we ratio the measurements of the cufflinks, with a solid smaller cufflink at the other end. So the final pair of cufflinks will look the same, but be of slightly smaller or bigger proportions. I will have drawings of this by the end of the day. When these drawings come out I am appealing to the masses to constructively criticise them and give thought to what should be changed. Another prototype will then be made. I’d like to thank Bondtoys, minigeff, Texas007, Asp9mm and gadgetmeister who have made strong contributions so far and have addressed issues that I most likely wouldn’t have. If there is anyone I have missed out, again, thank you. All of your points will and have been taken into consideration and hopefully that will reflect in the next prototype.
With all that said, which hopefully clears up a huge amount of problems and addresses a number of criticisms, I am now one short with TomSawyer out. If anyone wants to join in, let me know. Payment does not have to be made yet.

Mac, I'll not comment on your previous post as the turn comes very surprisingly and you will be not measured by your words but with what you are doing.
Trying to be constructive, I have 2 points, which worry me:
1. I know, that you can refund PayPal payments in full and by doing this, you also get the PP fees refunded. I am not sure, if there is a deadline for the PP fees refund. You may loose the PayPal fees, if someone later asks for a refund.
2. You state, that the Silversmith is located in the US.
a) was he the one, who made the 1st prototype or did you chance horses in the meantime?
b) If the cufflinks are produced in the US, they are subject to V.A.T and probably import duty.
Where taxes and fees subject to your calculation or are these coming on top for the case, that they are shipped out to the takers directly from the U.S.?
If you receive the cufflinks as a batch, have you encountered taxes and duties as they will be applied to you then?

a) was he the one, who made the 1st prototype or did you chance horses in the meantime?
b) If the cufflinks are produced in the US, they are subject to V.A.T and probably import duty.
Where taxes and fees subject to your calculation or are these coming on top for the case, that they are shipped out to the takers directly from the U.S.?
If you receive the cufflinks as a batch, have you encountered taxes and duties as they will be applied to you then?
